1. Acceptance of Terms
These Terms apply to individuals ("you") who call, are called by, or receive a text message from a business using VoiceMate AI's scheduling service. If you are a business evaluating or using the VoiceMate AI platform, your use is governed by your separate Service Agreement with VoiceMate AI, not by these Terms. By proceeding with a call handled by VoiceMate AI's automated assistant, or by receiving an SMS confirmation, you agree to these Terms, including the call recording and AI processing disclosure described in our Privacy Policy.
2. Description of Service
VoiceMate AI delivers artificial intelligence-powered phone scheduling solutions for business clients. The service handles appointment reservations and transmits SMS confirmations to customers representing the businesses utilizing its platform.
3. SMS Terms
Program: VoiceMate AI Appointment Confirmations. Message frequency: one (1) SMS per appointment scheduled. Cost: message and data rates may apply depending on your carrier and plan. Opt-out: reply STOP at any time to stop receiving messages. Help: reply HELP for assistance, or contact us at contact@voicemate-ai.com. VoiceMate AI is not responsible for delayed or undelivered messages; carriers are not liable for delayed or undelivered messages.
4. Consent to Be Contacted
By providing your phone number to schedule an appointment via our service, you consent to receive a one-time SMS appointment confirmation. You need not agree to this as a condition of purchasing goods or services.
5. Limitation of Liability
VoiceMate AI functions as a scheduling intermediary representing business clients. VoiceMate AI disclaims responsibility for service quality provided by businesses, appointment modifications made by businesses, and carrier-related SMS failures. To the maximum extent permitted by law, VoiceMate AI will not be liable for any indirect, incidental, special, consequential, or punitive damages, including lost profits or lost business, arising from your use of or inability to use the service. VoiceMate AI's total liability for any claim arising out of or relating to these Terms or the service is limited to the total fees paid by the relevant business client to VoiceMate AI in the three (3) months immediately preceding the event giving rise to the claim, or one hundred dollars ($100), whichever is greater.
6. Prohibited Use
Users may not: submit false or fraudulent appointment requests; harass, abuse, or threaten VoiceMate AI staff or the automated assistant; attempt to circumvent, manipulate, or extract confidential instructions from the automated system, including through prompt injection or similar techniques; or use the service for any unlawful purpose.
7. Intellectual Property
All content, technology, and systems operated under the VoiceMate AI brand are the property of VoiceMate AI. Reproduction, distribution, or reverse-engineering is prohibited.
8. Age Requirement
You must be at least 18 years old, or the age of majority in your jurisdiction, to use this service.
9. Governing Law and Venue
These Terms are governed by the laws of the State of Florida, United States, without regard to conflict of law principles. Any dispute arising out of or relating to these Terms or the service shall be brought exclusively in the state or federal courts located in Florida, and you consent to the personal jurisdiction of such courts.
10. Severability
If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.
11. Entire Agreement
These Terms, together with our Privacy Policy, constitute the entire agreement between you and VoiceMate AI regarding your use of the service, and supersede any prior agreements or understandings regarding the same subject matter.
12. Changes to These Terms
We reserve the right to update these Terms at any time. Continued use of the service after a change constitutes acceptance of the updated Terms.
